Each traveller using the Sportpaleis Express automatically accepts the general conditions, as outlined in this document.
The only task of the Sportpaleis Express is to organise the joint transport of persons to the Sportpaleis in Antwerp, from various, previously determined pick-up locations in Flanders.
Every traveller must have a valid proof of transport available, made out to their name, which can only be bought online via the website www.teleticketservice.com. Travellers will therefore be required to present the printed electronic proof of transport (e-bus ticket) when boarding the Sportpaleis Express. All elements of the printed version need to be clearly legible. In case of doubt and illegibility, the carrier may refuse entry. The proof of transport is only valid on a specific date for a direct trip from a specific pick-up location to the Sportpaleis and back again to the original pick-up location. If the date mentioned on the e-bus ticket does not correspond with the date of the event in question, entry to the bus may be denied by the carrier.
The proof of transport (e-bus ticket) must be presented to the driver or person appointed as being responsible for the bus, when boarding. If the traveller is unable to present a valid proof of transport, entry will be denied.
Travellers must hang on their valid proof of transport (e-bus ticket) throughout the entire trip and must always be able to show it to the driver or person in charge of ticket inspection.
Travellers cannot hold the carrier liable for the loss of their ticket.
Travellers must be able to prove their identity and the carrier is authorised to request proof of identity from the traveller, as issued by the competent authorities, so as to prove that they are the rightful owner of the electronic proof of transport.
The proof of transport is valid for both the outbound and return journey. If travellers lose their proof of transport during the concert or event, boarding for the return trip may be denied.
As the travel documents can be printed multiple times, travellers are not allowed to transfer copies to third parties. If two or more travellers show up with the same proof of transport, only one traveller will be transported under the proof of transport submitted.
The proof of transport may not be resold or transferred to third parties by the party making the order and/or the traveller.
a. Timetable
The timetable followed by the Sportpaleis Express can be consulted online at all times, via the website www.sportpaleis.be. The timetable may be changed up to 48h before the scheduled time of departure.
It is the travellers’ responsibility to check the final times of departure and arrival.
As the pick-up locations are public sites, they may be subject to change as a result of interventions by the local authorities.
Any change in the timetable that is carried out in good faith and/or for reasons of necessity does not entitle travellers to compensation or damages.
b. Departure
The timetable and, specifically, the departure times of the Sportpaleis Express will be strictly observed. In other words, the Sportpaleis Express will leave exactly on time. Travellers are recommended to be on-site at least 15 minutes before the time of departure mentioned.
Under no circumstance will the carrier be required to wait any longer than the scheduled time of departure.
The buses of the Sportpaleis Express are clearly identifiable by means of a sign displayed behind the windscreen and back window.
The logo of the Antwerp Sportpaleis is clearly posted on these signs.
During the outbound trip, the Sportpaleis Express will take the travellers to the entrance of the Sportpaleis and it will then pick them back up at the location indicated for the return trip. The organisers will provide sufficient signs.
c. Return trip
The return trip starts 30 minutes after the end of the concert or event. The driver or person appointed as being responsible for the bus will check the validity of the proof of transport, but does not check whether all persons who were present for the outbound trip are also actually present for the return trip.
For the return trip from the Antwerp Sportpaleis, the sign at the front and the back of the bus clearly mentions the destination.
The Sportpaleis Express leaves at the time indicated, regardless of whether everyone is present. It is the travellers’ responsibility to report to the bus on time for the return trip. Travellers who miss their return trip because they reported in late are not entitled to compensation or damages.
d. Force majeure
Any delays as a result of traffic jams, queues, technical malfunction of the bus, unexpected detours and road works, traffic accidents, bad weather conditions, irregularities or incidents during the trip will be considered force majeure.
The organisation cannot be held liable for any delays incurred as a result of force majeure. Travellers declare that they will not claim for compensation or damages in any way, in case of delays caused by force majeure.
a. Upon departure
Travellers are required to board at the front of the bus and to show their proof of transport to the driver or person appointed as being responsible for the bus.
b. During the entire course of the trip
Travellers on board of the Sportpaleis Express are not allowed to:
Drivers of a vehicle of the Sportpaleis Express and persons in charge of supervision may deny access to travellers or request them to leave the vehicle if they fail to comply with the provisions of these general conditions.
For reasons of safety, children under the age of 16 are not allowed to travel unaccompanied on the Sportpaleis Express. Any minor (under the age of 18), accompanied or not, will travel under the responsibility of their parents (or guardian, or person accompanying the minor on behalf of the parents).
Animals are not allowed on the Sportpaleis Express, except for guide dogs for people with a visual disability or dogs accompanying a police officer.
Travellers are allowed to bring along hand luggage, including a pushchair or wheelchair. Travellers will supervise their hand luggage taken aboard a vehicle of the Sportpaleis Express. Travellers may be held liable for damage caused by the hand luggage taken aboard the vehicle, unless it is demonstrated that the damage was caused by the carrier or Sportpaleis Express.
The driver may refuse to carry luggage, packets or objects if they, because of their size, nature or smell, may injure, soil, hinder or be a nuisance for the other travellers.
If this refusal means the traveller decides not to take part in the trip, the carrier cannot be held liable for this.
The carrier cannot be held liable for any loss or theft of personal property, such as luggage, of travellers.
Travellers undertake to attend to their own luggage. If travellers leave behind objects or luggage in the Sportpaleis Express, the carrier will only attempt to notify travellers if they have attached an identification label or if some other form of identification is present. If identification is not possible at all, the carrier is not required to ascertain the identity of travellers.
If travellers claim a lost object or piece of luggage, carrier is entitled to require any proof he deems necessary to ascertain the actual owner of the object or luggage.
Discarded objects or luggage will remain available with the carrier for a period of 14 days following the bus trip in question. However, if so required for reasons of hygiene or safety, the carrier is entitled to destroy the objects or pieces of luggage immediately.
When the provision of services by the Sportpaleis Express does not meet the minimum standards, travellers can only file a complaint by means of a registered letter, courtesy of the Sportpaleis Express, Schijnpoortweg 119, 2170 Antwerp and provided that it is sent within eight days after the date of the trip in question. The complaint must be accompanied by a copy of the proof of transport.
The registered letter must be addressed to the following address: Sportpaleis Express, Schijnpoortweg 119, 2170 Antwerpen.
If the complaint is founded, Sportpaleis Express will provide compensation which is proportionate to the nuisance caused, however, without it exceeding the amount of the sale price of the e-bus tickets, except if the failure is due to an unforeseeable or inevitable event, occurring outside of the control of the Sportpaleis Express.
Liability of the Sportpaleis Express is limited to organising appropriate transport from and to the Sportpaleis according to a previously communicated timetable. Sportpaleis Express expressly limits its liability to this scope. Sportpaleis Express does not assume any responsibility for the travellers using its services, regardless of whether they are of age or not.
Liability of the Sportpaleis Express is, at any rate, limited to the maximum amounts covered under its civil liability and professional liability insurance policies.
These general conditions are governed and will be interpreted in accordance with Belgian law.
If some provisions of these general conditions are considered to be non-enforceable, the other provisions will continue to apply and the non-enforceable provision will be replaced by the enforceable provision that is closest in meaning to the underlying meaning of the non-enforceable provision.
Any dispute resulting from the carrier agreement entered into with Sportpaleis Express will be the exclusive competence of the courts of the district of Antwerp.
